Pretrial Services

The Pretrial Services office is a Community Corrections program providing an array services to the courts and to moderate to high risk defendants; some of the services include Bond Review and Recommendations, Risk/Needs assessments and various forms of community supervision.  The Community Corrections office utilizes evidence based practices and procedures to implement the least restrictive bond conditions and reduce the failure to appear rate amongst criminal justice involved offenders.

Pretrial Supervision
For in-custody felony defendants who meet the eligibility criteria for community supervision as a condition of release.

Eligibility Criteria:
Pretrial defendants 18 years of age or older
Current offenses must be a felony or high risk misdemeanor offense
Defendant has not demonstrated a pattern of violent behavior
Defendant does not live with the alleged victim
Defendant demonstrates specific risk factors

Pretrial Supervision Options

Day Reporting
Requires defendant to maintain contact with the Pretrial Services office and abide by ordered conditions while their case is active.

Requirements:

  • Defendant may be on Circuit Court probation with new charges pending
  • Minimum of 1 risk factor but not more than 3 risk factors
  • Specific first-time felony offenders are eligible
  • Misdemeanor defendants with prior felony convictions may be considered. 

MOR (Monitor on Release)*
Requires the defendant to be supervised on electronic monitoring and abide by ordered conditions while their case is active.

Requirements:

  • Defendant may be on Circuit Court probation with new charges pending.
  • Minimum of 2 risk factors
  • Misdemeanor defendants with prior felony convictions may be considered.

* First time felony offenders are eligible for MOR under extraordinary circumstances, per instruction of the court; however, the majority qualify for Day Reporting.

Additional Services While on Pretrial Release

  • Assessment referral to substance abuse counseling and mental health services
  • Urinalysis and breathalyzer monitoring
  • Job, school and program attendance monitoring
  • Communication with Circuit Court Probation and District Court Probation
  • All pretrial release conditions ordered by court

Partial list of risk factors:

  • Two or more prior non-assaultive felony offenses
  • History of failure to appear
  • Probation violation
  • No significant ties to the community
  • Mental Health issues
  • Bench warrant was previously necessary
  • Gang Affiliation
  • Indication of drug and/or alcohol abuse
